La trasferencia de datos de mensajería financiera de la Unión Europea a los Estados Unidos

The European Union and the United States concluded in 2010 the Agreement on the processing and transfer of financial messaging data from the European Union to the United States for the purposes of the Terrorist Finance Tracking Program (Terrorist Finance Tracking Program), known as “SWIFT Agreement”. The aim of this paper is to examine to what extend the SWIFT Agreement reached the right balance between the need to transfer personal data to the United States in order to fight against terrorism and the obligation to protect personal data.
